Statement of Responsibility and Declaration of Informed Consent

Tethered Flight – ADULT OR MINOR PARTICIPANT

I hereby declare that I have been informed of the general flight conditions and that the participant is in perfect physical and psychological condition to take part in a tethered hot air balloon flight during the Festival Internacional de Balões Ar Quente (FIBAQ 2025), taking place from November 8th to 13th, 2025, in the municipalities of Alter do Chão, Benavila, Fronteira, Monforte, and Ponte de Sor.

1. Safety Conditions

I declare that I have been informed that, for safety reasons, the Festival organization will not allow flight participation to individuals who, due to their physical, psychological, or behavioral condition, may jeopardize their own safety or that of other participants, including:

• Pregnant women;
• Children under 6 (six) years of age;
• People with heart conditions, bone or joint problems (osteoporosis or similar conditions);
• People who suffer from epilepsy or severe mental disorders (such as schizophrenia or similar conditions);
• People who have recently undergone invasive treatments (chemotherapy or similar) or surgeries;
• People with reduced mobility or who require physical assistance (such as canes or similar support);
• or any other condition that, in the judgment of the organization or the pilots, may compromise the participant’s safety and the safety of the flight.

The organization and/or the pilots have full authority and may decide, at any time, whether the participant is fit to fly safely, and may cancel or postpone the flight for safety, technical, or adverse weather reasons.

Minor participants must always be accompanied by a responsible adult, who shall remain with the minor throughout the entire tethered flight.

2. Nature and Risks of the Activity

I declare that I have read and fully understood the General Conditions of Participation, Safety Rules, and Terms and Conditions applicable to FIBAQ, acknowledging the nature and specific characteristics of hot air balloon flight activities.

I am aware that this is a high-risk activity, dependent on weather conditions and technical factors, and that unforeseen events may occur, resulting in delays, changes, or incidents.

I agree to participate — or, when applicable, authorize the participation of the minor for whom I am responsible — freely, consciously, and with full understanding, assuming the normal and foreseeable risks inherent to the activity.

I am aware that, under no circumstances, will unaccompanied minors be allowed to participate in the tethered flight, and that the accompanying adult must also have an individual registration properly submitted and confirmed by the event organization.

3. Participant Responsibilities

I commit to following all safety instructions provided by the pilots and the organization, as well as acting prudently and providing truthful information regarding the participant’s health condition.

4. Passenger Distribution and Boarding Conditions

I declare that I have been informed that the distribution of passengers among the balloons is determined exclusively by the organization, taking into account the capacity, technical conditions, and balance requirements of each aircraft.

For this reason, it may be necessary to assign passengers of different weights or, in certain situations, limit the occupancy of a balloon to a single participant.

The organization does not guarantee that participants will be able to fly accompanied by the people with whom they registered, except in the case of minors.

The participant’s refusal to accept the assigned distribution or boarding conditions will result in the loss of the right to the tethered flight, without entitlement to a refund or rescheduling.

5. Assumption of Risk and Limitation of Liability

I acknowledge that participation involves the voluntary assumption of the normal and foreseeable risks of the activity, and that the organization cannot be held responsible for occurrences resulting from factors beyond its control, including:

• Operational and technical decisions of the pilot;
• Sudden weather changes;
• Failure of the participant to comply with safety instructions.

6. Role and Responsibility of the Organization

I am aware that Publibalão – Publicidade, Lda. (NIPC 503 425 052, headquartered at Rua Eng.º Manuel Rocha, 1-B, R/C, 1700-104 Lisbon) and Alentejo Sem Fronteiras – Clube de Balonismo (NIPC 509 643 094, headquartered at Estrada Ribeiro da Lapa, Lote 56, 7460-103 Fronteira – Portalegre) act as the promoters and organizers of the event, being responsible for the logistical and administrative coordination of FIBAQ, without technical involvement in the operation of the aircraft, which is the sole competence and responsibility of licensed pilots holding civil aviation liability insurance policies, in accordance with Regulation (CE) No. 785/2004.

7. Limitation of Liability

I declare that I understand that the Organization cannot be held liable for:

• Incidents arising from the technical operation of the aircraft or from unpredictable weather conditions;
• Failure of participants to comply with safety instructions.

This limitation does not exclude the Organization’s liability in cases of willful misconduct, gross negligence, or breach of legal safety obligations, in accordance with the Civil Code.
